Advertising and Promotion Policy
Last updated
1. Introduction
This Advertising and Promotion Policy (the “Policy”) defines the rules and guidelines for all advertising and promotional activities conducted by content creators, users, and other parties on Excluvia (the “Platform”) ensuring that all promotional content is consistent with our values, complies with applicable laws, and provides a fair experience for all users.
This Policy applies to all advertising, promotional activities, and third-party collaborations, whether digital or physical, that occur on the Platform or in relation to the Platform's services.
2. Definitions
“Advertisement (Ad)” means any form of promotional content, whether paid or unpaid, created to promote or market a product, service, brand, or event on the Platform.
“Advertiser” means an individual, Content Creator, Brand, or entity that uses the Platform to promote or advertise products, services, or events to users of the Platform.
“Brand” means a company, nonprofit organization, or any entity (such as a product or service provider, media company, or digital platform) that wishes to advertise its goods, services, campaigns, or initiatives to the Platform users.
“Content Creator” means an individual or entity who produces and uploads content (such as videos, photos, blogs, or live streams) on the Platform. Content creators may also promote products or services, either their own or from external Brands, through Ads and sponsorships.
“Sponsored Content” means any content created by a Content Creator or Brand that is promoted in partnership with an Advertiser, or Brand. This content is typically labeled as “Sponsored” or “Paid Partnership” and is intended to promote a product, service, or brand to users of the Platform.
“Sponsored Post” means a specific type of Sponsored Content where a Content Creator posts an Advertisement or promotional message on their page. This post may include text, images, videos, and links, and is meant to generate visibility and engagement for the advertised product or service.
“Promotion” means any activity or strategy used to market a product, service, or content to users of the Platform. Promotions can include discounts, giveaways, special offers, contests, affiliate marketing, or any other activity designed to encourage engagement or purchasing behavior.
3. General Principles
3.1. All Advertisements and Promotions must be truthful, accurate, and not misleading. Advertisers must clearly disclose any material relationships with the products or services being promoted.
3.2. Excluvia prioritizes content creators and their audiences. Any Advertisement or Promotion must not disrupt the creator-fan relationship or undermine the integrity of the content.
3.3. All Promotion must be clearly distinguishable from regular user-generated content. Users should always be aware when they are viewing an Ad, Sponsored Post, or any promotional material.
3.4. Ads must align with the Platform's Community Guidelines. Ads and Promotions should not exploit users' data or violate their privacy. Any form of discrimination, hate speech, or illegal content will be strictly prohibited.
3.5. All Ads or Promotions should not engage in unfair competition by denigrating competitors, misrepresenting their products, or making comparisons that are unsubstantiated. All advertisements must respect the dignity of the individual and avoid any form of exploitation, degradation, or humiliation of any person or group. Advertisements that promote violence, discrimination, or any kind of derogatory stereotypes are not permitted.
3.6. Ads should not be offensive to public morality, and they must respect the cultural norms of the viewers’ society.
4. Advertising Guidelines for Content Creators
Content creators have the freedom to promote their own work, brand, or services. However, all promotional activities must comply with the following guidelines:
4.1. Content creators can promote their content, products, or services via Ads within the Platform. These Ads should align with the Content Creator’s overall brand and should not mislead their audience.
4.2. Advertisements must be properly labeled as "Ad" or “Sponsored” in clear terms.
4.3. The Content Creator must ensure that their promotions comply with all local laws and other Platform rules. Misleading Ads will result in removal and possible penalties.
4.4. Content Creators can partner with Brands for Sponsored Posts in their content. All Sponsored Content must be clearly marked as "Sponsored" or "Paid Partnership".
4.5. Sponsored Posts should blend seamlessly with a Content Creator's existing content but should not overpower the user’s experience or be excessively frequent.
4.6. Content Creators must disclose any affiliate or referral links associated with the Promotion.
4.7. Content Creators are responsible for ensuring that Sponsored Content does not violate any of the Platform’s Community Guidelines, including restrictions on adult content, violence, and misleading claims.
4.8. Content Creators can run Promotions directly within their content, but these must include clear and transparent terms, including how to participate, any eligibility restrictions, and the duration of the offer.
4.9. Promotions must not mislead users. All Promotions, such as a special offer for content, should be clearly communicated.
4.10. Content Creators can promote different subscription levels. Any promotional activity related to subscription offers, such as discounts for yearly subscriptions, must be clearly explained to users.
4.11. Subscription Promotions must be transparent about pricing, access levels, and benefits associated with each tier. Content Creators must specify what type of content (e.g., exclusive content, early access) is accessible via each subscription tier.
5. Advertising Guidelines for Brands
Brands can engage with the Platform’s community by promoting their products or services but must adhere to specific standards to ensure that their promotions are ethical and non-intrusive.
5.1. Brands can create free pages on the Platform to showcase their products and services. However, Brand pages must not contain any paid content or subscription-based access. These pages should follow all content guidelines and should not be used as a platform for misleading or intrusive advertising. Brands must refrain from exploiting user data or using deceptive tactics to increase engagement.
5.2. Brands may sponsor Content Creators' posts or place Ads within the Platform’s user feed. All Sponsored Posts must be clearly labeled with the terms "Sponsored" or “Ad”.
5.3. Ads shall not overwhelm the user’s experience and should align with the interests and needs of the target audience. The frequency of Sponsored Content should be kept reasonable.
5.4. The Platform reserves the right to reject any Sponsored Content that does not comply with the Platform's standards, or that disrupts the flow of user-generated content.
5.5. Ads promoting illegal activities (e.g., drug use, human trafficking, gambling, etc.), harmful products (e.g., tobacco, excessive alcohol), or content that violates the Platform's Community Guidelines will be immediately removed.
5.6. Ads should not promote violence, hate speech, discriminatory practices, or anything that can be considered offensive or inappropriate for the platform's audience.
5.7. Any product or service targeting minors inappropriately will also be prohibited.
5.8. Brands wishing to run large-scale promotional campaigns (e.g., discounts, product launches, etc.) can do so via sponsored ads. All promotional offers must comply with the Platform’s rules regarding transparency, clarity, and user experience.
5.9. Any offers related to the Brand must be communicated clearly, with all terms and conditions explained in full.
6. User Engagement with Ads
Excluvia aims to provide a balanced and non-intrusive advertising experience. Here is how users can interact with advertisements:
6.1. Users can like, comment, and share Ads or Promotional content as long as it does not detract from their overall user experience.
6.2. The engagement with Ads should be minimal and not forced upon the user. Ads should be as unobtrusive as possible while still offering a valuable proposition to the user.
6.3. When Content Creators offer Promotions for their subscriptions (e.g., reduced rates for yearly subscriptions), users should receive notifications and be given full details about the offer.
6.4. All subscription Promotions, including the terms, benefits, and potential limitations, must be clearly communicated before the user commits to a paid plan.
6.5. If users wish to promote their own services or products within the Platform (via posts, comments, or other user-generated content), it must not violate the Platform’s Community Guidelines. Unauthorized promotion or spam will result in penalties, including possible suspension of user accounts.
6.6. Users engaging in paid Promotions or Sponsored Content must disclose that their post is sponsored. The Platform encourages transparency in all promotional activities and requires users to follow legal and ethical standards when creating Sponsored Content.
7. Prohibited Promotional Practices
To maintain a positive and respectful community, the following practices are prohibited on the Platform:
7.1. Ads that mislead users regarding the nature of a product or service, or make exaggerated claims, will be removed immediately. Ads must not promise results or benefits that are unrealistic.
7.2. Ads that disrupt the user experience (e.g., pop-ups, auto-play videos, excessive frequency) are prohibited. Sponsored content must blend seamlessly with the platform’s layout and not interfere with content consumption.
7.3. Direct messaging for promotional purposes is not allowed. Content creators or brands may not spam users with unsolicited promotional material.
7.4. Any Ad or Promotion that violates the Platform’s Community Guidelines will be removed, and the account involved may face suspension.
8. Compliance with Laws and Regulations
All advertising and promotional activities must comply with local and international laws, including advertising standards, consumer protection laws, data protection regulations, and intellectual property rights within the jurisdiction which this Platform operates.
9. Monitoring and Penalties
9.1. Excluvia actively monitors all Advertisements and Promotions to ensure compliance with this Policy. Violations will lead to the following actions:
a. Any ad or promotional content found to be in violation of the policy will be removed.
b. Content creators or brands who repeatedly violate advertising guidelines may face suspension or permanent termination of their account.
c. Affected parties will be notified of the violation and the reason for removal or suspension.
9.2. Users or Advertisers who notice any violations of this Policy can report them to the Platform's support team at support@excluvia.com. All reports will be reviewed in accordance with our internal processes, and appropriate action will be taken.
10. Changes to the Policy
Excluvia reserves the right to modify or update this Policy as necessary. All changes will be communicated to the community through notifications and updates on the Platform. Users and advertisers are encouraged to review the Policy periodically to stay informed about the latest rules and guidelines
