1. INTRODUCTION
This Copyright Policy ("Policy") establishes the rules governing copyright ownership and related matters in connection with the use of Excluvia’s platforms and related digital products (each the “Platform”).
This Policy applies to all Excluvia users (“Users”) globally, subject to applicable local, national, and international laws. Where jurisdictional regulations impose additional requirements, Excluvia reserves the right to modify this Policy to ensure full legal compliance in the relevant regions.
This Policy is a legally binding part of Excluvia’s Terms of Use and must be read alongside our Privacy Policy, Acceptable Use Policy, and Community Guidelines.
By accessing or using our Services, you agree to comply with this Policy and all applicable laws and regulations. If you do not agree, you must immediately discontinue use of our Services, as continued use constitutes acceptance of this Policy and all related policies.
2. OWNERSHIP OF CONTENT
2.1. User Content
You retain full ownership of all content that you create and post on the Platform, including but not limited to text, photos, videos, music, audio clips, artwork, comments, and other user-generated materials (collectively, "User Content"), provided that such content is your own original work and does not infringe the intellectual property rights of others.
You are solely responsible for your User Content, including ensuring that you have all necessary rights, licenses, and permissions to post and share such User Content on the Platform.
2.2. License to Grant
By posting or uploading any User Content, Users grant Excluvia a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content for the purposes of operating, promoting, and improving the Platform and our services.
When you delete any User Content, it is removed from public view. However, it may remain on our servers for a limited time in backup or archived versions, or as required for legal or operational reasons.
2.3. Third-Party Content
User Content from third parties is subject to the intellectual property rights of those parties. Users must ensure they have the necessary rights to share such content.
3. PROHIBITED CONTENT AND RESPONSIBILITIES
3.1. You may not upload or share any User Content that:
a. Infringes another person’s copyright or intellectual property rights;
b. Was copied or reused from third-party platforms without permission;
c. Includes copyrighted music, video, or artwork unless properly licensed;
d. Contains AI-generated material that imitates real persons or brands without consent;
e. Violates the law or our community standards.
You are solely responsible for ensuring that you have obtained the necessary permissions or licenses before uploading any User Content that includes third-party intellectual property.
3.2. Remixed, Collaborative, or AI-Generated Content
If your User Content is the result of collaboration or includes material generated by artificial intelligence, you must ensure:
a. That all co-creators have granted permission for the upload and distribution;
b. That no likeness, name, image, or proprietary content is used without the owner’s consent;
c. That you respect rights of publicity and privacy, in addition to copyright laws.
3.3. Transformative Use and Fair Use
While some User Content may fall under "fair use", you are responsible for understanding and asserting any such claims. Excluvia is not liable for user misinterpretations of fair use doctrine.
4. INFRINGEMENT CLAIMS AND TAKEDOWN REQUESTS
4.1. If you believe your copyrighted work has been used on our Platform without authorization, you may submit a written notice including the following:
a. Identification of the copyrighted work claimed to be infringed;
b. Identification of the infringing material and its location on the App (URL or description);
c. Your contact information (email, phone, address);
d. A statement that you have a good faith belief that the use is unauthorized;
e. A statement that the information in your notice is accurate, and that you are the copyright owner or authorized to act on the owner’s behalf.
Please send notices via e-mail to support@excluvia.com
4.2. You may also report an infringing User Content directly through the Platform. To do so:
a. Click on the three dots on the top right of the content to report;
b. Select the Report this content link; and
c. Select the category to report the content under and submit for review.
4.3. Upon receipt of a valid notice of violation, Excluvia may:
a. Remove or restrict access to the infringing User Content;
b. Notify the User responsible for posting the material;
c. Allow the User to file a counter-notice under applicable law.
5. COUNTER-NOTICE PROCESS
If you believe your User Content was removed in error, you may submit a counter-notification in accordance with applicable copyright law. We will process such notices in line with legal requirements and may restore the User Content if appropriate.
6. REPEAT INFRINGER POLICY
Accounts associated with multiple valid copyright or intellectual property violation complaints may be suspended or permanently removed from Excluvia. To determine whether a User qualifies as a repeat infringer, please refer to the Monitoring and Enforcement section of our Acceptable Use Policy, which outlines the severity and frequency of violations; the steps we may take in response to infractions; and available appeals procedures.
We strongly recommend resolving any rights issues before posting User Content to avoid account restrictions or takedowns.
7. DISCLAIMER
Excluvia does not provide legal advice regarding copyright and intellectual property issues around User Content. Users are responsible for ensuring that they have the appropriate rights to all User Content they upload or share via the Platform.
8. MODIFICATION
Excluvia reserves the right to update, modify, or revise this Policy at any time. Any updates to this Policy will be effective upon posting on the Platform or as otherwise communicated to Users. Continued use of the Platform after any modifications to this Policy constitutes acceptance of the revised Policy.
9. DISPUTES
If you have questions or disputes about copyright ownership of User Content posted on the Platform, please contact us at support@excluvia.com.
